These Terms are an agreement between you and Matri Rush ("we", "us", "our"), of Ikeja, Lagos, Nigeria, about your use of the Animalculator app (the "App"). By installing or using the App you accept them. If you do not accept them, do not use the App.
We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App on devices you own or control, for your own non-commercial use, subject to the usage rules of the app store you installed it from. You may not copy, sell, rent, sublicence or redistribute the App, reverse engineer it except where the law expressly permits, or extract its illustrations, sounds or other assets for use outside the App.
The App is free to download and includes free animal packs. A single optional in-app purchase unlocks the remaining packs and backdrops permanently, on the stores and accounts you use it with. There is no subscription and no recurring charge of any kind. The price shown by your app store at the time of purchase is the price that applies.
Settings contains a tip jar. A tip is a voluntary payment to support the work and it unlocks nothing: it grants no packs, no features and no advantage, by design. Tips are consumable purchases, so the same tip can be given again later, and there is nothing to restore. Do not tip if you expect to receive anything in return.
All purchases are made through the app store, so refunds are handled by the store, not by us. On iOS use reportaproblem.apple.com; on Android use Google Play's order history. If a purchase did not unlock what it should have, email us first at support@matrirush.com and we will try to fix it, which is usually faster than a refund. Nothing here limits any statutory right of withdrawal or refund you have as a consumer where you live.
Use the App lawfully. Do not attempt to bypass its purchase checks, tamper with entitlement data, interfere with the app store's or our providers' systems, or use the App in a way that infringes anyone's rights.
The App calculates arithmetic and shows animal facts written for it. We take both seriously and check the facts, but the App is provided for everyday and educational use. Do not rely on it as the sole basis for a financial, medical, engineering, scientific or other consequential decision.
The App, its name, its code, its design, its sounds and the illustrations commissioned for it remain ours or our licensors'. Some plates in the App are reproductions of public-domain artworks held by museums and archives. Those are credited in the App with the artist, the work and the holding institution, and nothing in these Terms claims ownership of the underlying public-domain artwork itself.
The App runs on your device and works offline, but purchases, restores and the app store itself depend on third-party services and your internet connection. We do not guarantee the App will be uninterrupted or error free, and we may modify, suspend or discontinue features at any time.
The App is provided "as is" and "as available" without warranties of any kind, express or implied, to the extent permitted by law. To the maximum extent permitted by applicable law, our total liability for any claim relating to the App is limited to the greater of the amount you paid us for in-app purchases in the 12 months before the claim, or USD 50. Nothing in these Terms limits rights that cannot be limited under the law that applies to you as a consumer.
You may end this agreement at any time by deleting the App. We may end it if you materially breach these Terms. Purchases already made are not refunded on termination except where the law or the store's policy requires it.
We may update these Terms. We will revise the effective date above and, for significant changes, say so in the App. Continued use after a change means you accept it.
These Terms are governed by the laws of the Federal Republic of Nigeria, without regard to its conflict-of-laws rules. If you are a consumer, this does not deprive you of the mandatory consumer protections of the country where you live.
Where you obtained the App from the Apple App Store, the following also applies and, in the event of a conflict with the rest of these Terms, this section prevails:
