Terms of Service

These terms are the agreement between you and Matri Rush for Bottle Rush Shooting 3D. In plain words: the Game is free, it is yours to play but not to resell or pull apart, the coins and gems inside it are not money, and we can only promise the Game as it is — not that it will be perfect.

1. Agreement

By downloading, installing or playing Bottle Rush Shooting 3D (“the Game”) you agree to these Terms of Service (“Terms”) with Matri Rush (“we”, “us”) of Ikeja, Lagos, Nigeria. If you do not agree, do not install the Game, and delete it if you already have.

Our Privacy Policy forms part of these Terms. These Terms cover Bottle Rush Shooting 3D only; our other titles have their own terms at matrirush.com/terms.

2. Who may play

The Game is suitable for a general audience. If you are under the age of majority where you live, you may play only with the permission of a parent or guardian, and that adult accepts these Terms on your behalf. The Game has no accounts, no chat and no user-to-user contact of any kind.

3. Your licence

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and play one copy of the Game on devices you own or control, for your own private entertainment. We keep every other right.

You may not:

• copy, sell, rent, lend, sublicense or redistribute the Game or any part of it;
• reverse engineer, decompile or disassemble the Game, except to the extent that applicable law expressly permits it despite this restriction;
• modify the Game, or use cheats, automation, injected code or modified save data to alter scores, coins, gems or unlocks;
• remove or obscure any notice of copyright, trade mark or ownership;
• use the Game's art, sound, code, characters, name or logo in your own product or promotion without our written permission.

4. Ownership

The Game — its code, art direction, characters, worlds, weapon designs, sounds, user interface, the name Bottle Rush Shooting 3D, the name Matri Rush and the associated logos — is owned by Matri Rush and protected by copyright and trade mark law. These Terms give you a licence to play, not ownership of anything.

The Game is built on open-source components, including three.js and Capacitor, which remain the property of their authors and are used under their own licences. Nothing in these Terms limits your rights under those licences.

5. Coins, gems and other virtual items

• Coins, retry gems, guns and finishes are a licensed feature of the Game, not property and not money. They have no monetary value, no exchange rate, and no existence outside the Game.
• They cannot be sold, traded, gifted, transferred between devices or accounts, or redeemed for cash or anything else of value.
• They are earned by playing, from the free daily crate, from optional rewarded ads, or by optional in-app purchase of a coin/gem bundle for real money.
• Your balances live in the save file on your device. If you reset your progress, uninstall the Game, clear its storage, lose the device or switch to a new one, that progress is gone and cannot be restored by us — we have no copy of it. There is no cloud save.
• We may change, rebalance, add or remove virtual items, prices, drop rates and game rules in any update, without owing you compensation.

In-app purchases are sold through Google Play or the Apple App Store, billed and processed by that store, and refunds are handled by that store under its own policy — not by us. Purchase confirmation passes through RevenueCat, our purchase-processing service, described in our Privacy Policy.

6. Updates and availability

We may update, change or discontinue the Game, in whole or in part, at any time. We may stop supporting older operating systems or devices. We do not promise that the Game will always be available, or that it will always run on any particular device.

7. No warranty

The Game is provided “as is” and “as available”, without warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, title or non-infringement. We do not warrant that the Game will be uninterrupted, error-free, or free of anything that could inconvenience you.

Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you. Where consumer law gives you guarantees that cannot be excluded — such as the Australian Consumer Law, the UK Consumer Rights Act 2015 or EU consumer legislation — those rights stand and nothing here limits them.

8. Limitation of liability

To the fullest extent permitted by law, Matri Rush is not liable for indirect, incidental, special, consequential or punitive damages, or for lost progress, lost virtual items, lost data, lost profits or device damage, arising out of or connected with the Game.

Where liability cannot be excluded, our total liability to you for any claim relating to the Game is limited to the greater of (a) the amount you actually paid us for the Game in the twelve months before the claim, which for a free game is nothing, or (b) US$10.

Nothing in these Terms excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded.

9. Health and safety

A very small number of people may experience seizures when exposed to flashing lights or patterns, including in video games. Stop playing and consult a doctor if you experience dizziness, altered vision, eye or muscle twitching, disorientation, or convulsions. Take a break of 10 to 15 minutes every hour, play in a well-lit room, and keep a comfortable distance from the screen.

10. Ending this licence

You may end this licence at any time by deleting the Game. Your licence ends automatically if you breach these Terms. Sections 4, 5, 7, 8, 11 and 12 survive the end of the licence.

11. Apple App Store terms

For copies obtained through the Apple App Store, the following apply:

• These Terms are between you and Matri Rush only — not with Apple. Matri Rush alone is responsible for the Game and its content.
• Your licence to use the Game is limited to the non-transferable licence to use it on any Apple-branded device you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
• Apple has no obligation to provide any maintenance or support for the Game.
• If the Game fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the Game.
• Matri Rush, not Apple, is responsible for addressing any claim relating to the Game, including product liability claims, claims that the Game fails to conform to a legal requirement, and consumer protection or privacy claims.
• Matri Rush, not Apple, is responsible for investigating and defending any third-party claim that the Game infringes intellectual property rights.
• You confirm you are not located in a country subject to a U.S. Government embargo or designated as “terrorist supporting”, and are not on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

For copies obtained through Google Play, the Google Play Terms of Service also apply to your download, and Google is not a party to these Terms.

12. Governing law

These Terms are governed by the laws of the Federal Republic of Nigeria, without regard to its conflict-of-law rules, and the Nigerian courts have non-exclusive jurisdiction. If you are a consumer, this does not deprive you of the protection of the mandatory consumer law of the country where you live, and you may bring proceedings in your local courts.

13. Changes to these Terms

We may revise these Terms. The revised version is published on this page with a new effective date, and applies from the first time you play the Game after it is posted. If you do not accept a change, stop playing and delete the Game.

14. General

If any provision of these Terms is found unenforceable, the rest stays in force. Our not enforcing a provision is not a waiver of it. These Terms, together with the Privacy Policy, are the entire agreement between you and us about the Game.
